By accessing or using PlayfulGifting ("the Platform"), available at playfulgifting.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

We reserve the right to update or modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

2. Description of Service

PlayfulGifting provides a creative platform for users to create, customize, and share digital gifting experiences including but not limited to: digital bouquets, sealed digital messages, wax seal letters, and interactive surprises. The Platform generates unique shareable links for each creation.

3. User Conduct

By using the Platform, you agree that you will not:

• Use the Platform to send harassing, threatening, abusive, or otherwise objectionable content
• Attempt to access, tamper with, or use non-public areas of the Platform
• Interfere with or disrupt the Platform or servers or networks connected to the Platform
• Use automated scripts or bots to create content or interact with the Platform
• Impersonate any person or entity, or falsely state or otherwise misrepresent your identity

4. User-Generated Content

You retain ownership of the messages, names, and content you create on the Platform. By using the Platform, you grant PlayfulGifting a non-exclusive, worldwide, royalty-free license to store, display, and deliver your content solely for the purpose of providing the service (i.e., displaying your creation to recipients via shared links).

We do not claim ownership of your content, nor do we use it for marketing, analytics, or any purpose beyond delivering your creation.

5. Privacy & Data

PlayfulGifting collects minimal data necessary to provide the service: sender names, recipient names, messages, and creation preferences (flower selections, envelope styles, etc.). We do not collect email addresses, phone numbers, or financial information.

Shared links are accessible to anyone with the URL. We recommend not including sensitive personal information in your creations.

We do not sell, rent, or share your data with third parties. We use industry-standard security measures to protect stored data.

6. Intellectual Property

All Platform content, including but not limited to the design, graphics, flower illustrations, animations, code, and branding, is owned by PlayfulGifting and protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from Platform content without explicit written permission.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Platform may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by service interruptions.

8. Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. IN NO EVENT SHALL PLAYFULGIFTING BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid to use the Platform (which, for free services, is zero).

9. Termination

We reserve the right to suspend or terminate access to the Platform for any user who violates these Terms, engages in abusive behavior, or uses the Platform in a manner that could harm other users or the service.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Platform shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
